SUPERNOVA Terms of Use

Welcome to SUPERNOVA®, a service provided by Daylight Technologies Zambia Limited (“SUPERNOVA”, “we”, “our”, or “us”). These Terms of Use govern your use of SUPERNOVA.app (together, the “Website”), our mobile and desktop apps (our "Apps"), and all related players, widgets, tools, applications, data, software, APIs (which may also be subject to separate API Terms of Use), and other services provided by SUPERNOVA (the “Services”). These Terms of Use, together with our Privacy Policy, Cookies Policy, Community Guidelines, and any other terms specifically referred to in any of those documents, constitute a legally binding agreement (the “Agreement”) between you and SUPERNOVA in relation to your use of the Website, Apps, and Services (together, the “Platform”).

These Terms of Use are divided into the following sections:

  • Acceptance of Terms of Use: By using SUPERNOVA®, you accept our Terms of Use, Privacy Policy, Cookies Policy, and Community Guidelines and agree to abide by them.
  • Changes to Terms of Use: Our Terms of Use may change from time to time.
  • Description of the Platform: A general description of the Platform, its features, and functionality.
  • Your SUPERNOVA Account: Your responsibilities if you register for a SUPERNOVA® account.
  • Your Use of the Platform: Your rights and conditions for using the Platform.
  • Your Content: Ownership of your content and your agreement not to upload infringing material.
  • Grant of License: How your content is used on SUPERNOVA® and the permissions you grant by uploading it.
  • Representations and Warranties: Promises you make when uploading content to SUPERNOVA®.
  • Liability for Content: SUPERNOVA is an interface provider only; users are liable for all content, including livestreams.

Acceptance of Terms of Use

Please read these Terms of Use, Privacy Policy, Cookies Policy, and Community Guidelines carefully. If you do not agree to any provisions in these documents, you should not use the Website, Apps, or Services. By accessing or using the Platform, registering an account, or viewing, accessing, streaming, uploading, or downloading any information or content, you represent that you have read and understood these documents, will abide by them, and are either 18 or older (or the age of majority in your jurisdiction), or, if under 18, are at least 13 and have parental or guardian permission to use the Platform.

Changes to Terms of Use

We may change, alter, replace, or modify these Terms of Use at any time. The date of last modification is at the end of this document. It’s your responsibility to check for updates. We’ll highlight changes on the Website. If you’re registered and we make material changes (e.g., for security, legal, or regulatory reasons), we’ll notify you via your SUPERNOVA® account or email. Revised terms take effect six weeks after notification. If you don’t terminate your account within that period, continued use constitutes acceptance.

Description of the Platform

The Platform is an interface that enables users to upload, share, and access content, including audio, video, text, photos, graphics, comments, and livestreams (“Content”). SUPERNOVA does not store, record, host, or distribute any Content, including videos and livestreams; all Content is uploaded, hosted, and managed entirely by users through third-party services or their own systems, and SUPERNOVA provides only the interface to facilitate these activities. Registered users can upload Content and use our tools to make it available to others, subject to territorial restrictions. We may introduce new tools, app versions, or features, all governed by these Terms of Use and any additional terms specific to those services. SUPERNOVA does not operate servers or infrastructure to host Content and is not responsible for its storage, transmission, or availability.

Your SUPERNOVA Account

Registration is optional but required for certain features, like using our Apps. When registering, you’ll provide an email address and choose a username and password. Keep your email valid and your credentials secure—you’re responsible for all activity on your account. If your credentials are compromised, notify us in writing and change your password immediately. We may cancel or reassign usernames and suspend or terminate accounts for violations of these Terms of Use, Community Guidelines, or applicable laws, with or without notice. You can terminate your account as outlined in the Termination section.

Your Use of the Platform

Subject to strict compliance with these Terms of Use and Community Guidelines, SUPERNOVA grants you a limited, personal, non-exclusive, revocable, non-assignable license to use the Platform to view, listen to, and share Content where permitted by the uploader (“Uploader”). Registered users may also upload and manage Content, participate in community features, and use additional Services, all subject to these terms. You must not:

  • Copy or capture Content except as permitted by the Uploader.
  • Republish or exploit Content except your own or as allowed.
  • Use Content to create competing services.
  • Scrape or misrepresent activity (e.g., via bots).
  • Alter trademarks or bypass protections.
  • Upload illegal, harmful, or infringing Content, including during livestreams.
  • Host, stream, or distribute Content through SUPERNOVA’s infrastructure (as none exists for this purpose).

Violations may lead to account termination, legal action, or reporting to authorities.

Your Content

Content you upload, store, share, or stream (“Your Content”), including livestreams, is yours, not SUPERNOVA’s. You’re solely responsible for it. SUPERNOVA does not host, store, or transmit Your Content; it is uploaded, hosted, and streamed via user-selected third-party services or systems, with SUPERNOVA providing only the interface. You must own or have rights to all Content you upload or stream—unauthorized use of copyrighted material is prohibited and may lead to account termination or legal action. By using the Platform, you acknowledge that SUPERNOVA has no control over the hosting, storage, or distribution of Your Content.

Grant of License

By uploading or streaming Your Content, you direct SUPERNOVA to provide an interface for its use, granting us a limited, worldwide, non-exclusive, royalty-free license to facilitate this through the Platform’s features. This license does not include hosting or storing Content, as SUPERNOVA does not perform these functions. You also grant other users and linked services a similar license to use Your Content within the Platform’s features, as you permit. Licenses end when you remove Content, though content shared externally may persist beyond our control.

Representations and Warranties

You warrant that Your Content, including livestreams, is original or properly licensed, does not infringe rights, and complies with laws and our Guidelines. You further warrant that you are solely responsible for securing all necessary rights for hosting, storing, and distributing Your Content via third-party services. Breaches may result in removal, account termination, or legal action.

Liability for Content

SUPERNOVA provides an interface only and does not host, store, transmit, or distribute Content, including videos, audio, or livestreams. All Content is uploaded, hosted, and managed by users through third-party services or their own systems, and users are solely responsible for it. SUPERNOVA acts as a passive facilitator, exercising no control over Content’s creation, hosting, or distribution. We don’t review all Content and aren’t liable for it, excluding all liability for infringement, defamation, or other issues to the fullest extent permitted by law. You waive any claim against SUPERNOVA or Daylight Technologies Zambia Limited arising from Content or its use.

Copyright Compliance and Safe Harbor

SUPERNOVA is committed to copyright compliance but does not host, store, or distribute Content, including livestreams. We rely on users to upload and host Content lawfully via third-party services. To the fullest extent permitted by law, SUPERNOVA and Daylight Technologies Zambia Limited disclaim all liability for copyright infringement or other violations related to Content. We will promptly remove or disable access to allegedly infringing Content upon proper notification (see Reporting Infringements), but we have no obligation to monitor Content proactively, as we lack direct access to its hosting infrastructure. Users bear full legal responsibility for ensuring their Content complies with all applicable copyright laws.

Reporting Infringements

Report copyright infringement via buttons on track pages or by written notice with required details (e.g., description, contact info, statement under penalty of perjury). SUPERNOVA will act expeditiously to disable access to reported Content within our interface, though we cannot remove it from third-party hosting services.

Third Party Websites and Services

The Platform may link to external services (e.g., hosting providers, streaming platforms) not controlled by SUPERNOVA. We’re not responsible for their content, operation, or compliance with copyright laws. Review their terms before use—you assume all risks associated with these services.

Blocking and Removal of Content

We may block or disable access to Content within our interface for any reason, including suspected violations, without liability. We cannot remove Content from third-party hosting services, and Uploaders may also remove their Content without notice.

Repeat Infringers

Repeated breaches or copyright violations may lead to account suspension or termination after warnings or immediately if court-ordered. We reserve the right to report infringers to authorities.

Disclaimer

The Platform is provided “as is.” We don’t host Content and can’t guarantee its availability, quality, or legality. SUPERNOVA makes no warranties about third-party services used for hosting or streaming.

Limitation of Liability

To the fullest extent permitted by law, SUPERNOVA and Daylight Technologies Zambia Limited, including their subsidiaries, affiliates, employees, agents, directors, and shareholders, are not liable for any damages (direct, indirect, incidental, consequential, or otherwise) arising from Content, including copyright infringement, whether hosted, streamed, or accessed via the Platform or third-party services. This includes no liability for losses related to account termination, Content unavailability, or legal actions by rights holders.

Indemnification

You agree to indemnify and hold harmless SUPERNOVA, Daylight Technologies Zambia Limited, and their affiliates from any claims, damages, or losses (including legal fees) arising from Your Content, its hosting, or your use of the Platform, including any copyright infringement claims.

Data Protection, Privacy, and Cookies

Your data is handled per our Privacy Policy and Cookies Policy. Review them carefully.

Meetups, Competitions, and Other Promotions

These are user-run, not SUPERNOVA events—we’re not responsible.

Use of SUPERNOVA Players and Widgets

Don’t use our tools to build competing services or bypass third-party hosting.

Subscriptions and Gift Codes

See our subscription terms for purchase and cancellation details.

Changes to the Platform, Accounts, and Pricing

We may adjust the Platform; your rights are outlined here.

Termination

You or we may terminate your account under specified conditions. Termination does not obligate SUPERNOVA to remove Content from third-party services.

Assignment to Third Parties

We may transfer this Agreement.

Severability

Invalid terms are removed without affecting the rest.

Entire Agreement

These Terms, Privacy Policy, Cookies Policy, and Guidelines govern your use.

Third Party Rights

This Agreement is between you and SUPERNOVA only.

Applicable Law and Jurisdiction

Governed by Zambian and British law.
